If your application to the scheme was unsuccessful, you can appeal the decision.
Reasons for an appeal
An appeal may be considered for two reasons. If you feel:
- we were incorrect to decide that you were not eligible for a payment under the scheme criteria
- our decision on a support and assistance grant was not justified on the guidance we provided
We will not consider an appeal where you:
agree you are not eligible under current criteria, but disagree with the criteria

How to appeal
If you wish to appeal, you should contact us within 3 months from the date on the rejection letter. We may consider appeals received after 3 months, but only if you can provide a good reason for not contacting us earlier.
To appeal, you must contact us.
You must outline your reason for making the appeal. You do not have to provide any extra information, but if there's any additional evidence that you feel is relevant, you can provide it.
What happens next
An impartial expert panel will meet and review your application. Each panel member has relevant clinical or similar experience to enable them to consider appeals.
The panel will review the information provided in:
- your application form
- any statements from doctors
- any extra evidence you have supplied
The panel may seek further evidence from you and your medical practitioner. We'll write to you both with the request. If there's a delay in the panel reaching their decision, we'll write to let you know.

The appeal decision
The panel may overturn the original decision and approve the application.
If your appeal is successful we'll process your application as soon as possible. We'll arrange for any payments due to you.
You may have applied for regular payment (annual or income top-up support). We'll backdate your payments to the date we received your application.
If your appeal is unsuccessful, you cannot submit a second appeal in relation to the same application.
However, you can appeal again if you submitted two different applications for different types of payments, with both refused.
