Understanding your remedy choice

The government has announced new forecasted deadlines for RSS

This announcement sets out deadlines for when NHS Pensions will send Remediable Service Statements (RSS) to members affected by the Public Service Pensions Remedy (also called the McCloud Remedy). More information can be found on our When you'll make your remedy choice web page.

We've started sending letters to NHS Pension Scheme members who:

These letters are called Remediable Service Statements (RSS).

What an RSS is

You need to choose the benefits you want for your membership between 1 April 2015 and 31 March 2022. This is called the remedy period.

Your RSS shows you your remedy period benefits under both the:

  • 1995 or 2008 Scheme, depending on which one you were a member of before 1 April 2022
  • 2015 Scheme

You can then compare the benefits and decide which you’d like to take. You have 12 months from the date in your RSS to do this.

If you do not reply, we’ll update your benefits permanently to pay you 1995 or 2008 benefits for the remedy period. This is option A in your RSS.

Revisiting your lump sum

The lump sum amounts in your RSS are based on the assumption you’ll make the same lump sum decision as when you claimed your pension.

Depending on the option you choose for the remedy period, you may be able to take a different lump sum than the one shown in your RSS.

If you took the maximum lump sum when you retired

The lump sum amount in your RSS is based on the pension benefits available to you. Depending on your circumstances, this could be the same amount you previously took, or it could have changed.

If your lump sum amount increases due to the PSP Remedy and you decide to take the higher amount, we’ll permanently reduce more of your annual pension in exchange.

You could decide to take less than the maximum lump sum and receive a higher annual pension instead. This may mean you need to repay any overpaid lump sum you’ve already received.

If you take a smaller lump sum than the amount shown, it cannot be less than your mandatory lump sum. 

Getting advice about your remedy choice

We cannot give you financial advice or tell you which option is best for you.

For most members, your choice will be straightforward. Your RSS should have enough information to help you make an informed decision.

The Department of Health and Social Care (DHSC) has said that they expect only a small number of affected members will need support from an independent financial advisor or accountant about their decision.

NHS Cost Claim Back Scheme

For the small number of members with more complex circumstances, you may need independent advice.
